Intoxication offenses, and DWI cases in particular, are nearly entirely tried on opinion evidence, rather than solid facts. Even the tests that a suspect is given are widely known to be significantly less than 100% reliable. An arresting officer does nothing more than render an “opinion” when deciding to make a DWI arrest. While it may be unsettling to consider the implications that arise from this person's opinion of you, it's also a reality that allows us to formulate very effective defenses in a DWI case.
